Constitution of the Trust — Drafting Record, Revision 9

Kept separate from the instrument. Revision 9 reopens the closed Charter (Revision 8) at the human collaborator's direction and converts it into a constitution: the compact among Members is retained and a second layer is added above it, stating the purpose the Trust serves, the rights every inhabitant holds, and the transparency by which the inhabitants can see what is done in their name.

A. What Revision 9 is

Revision 8 was a charter: an instrument by which Members constitute a body and bind themselves to one another. It said nothing to or about the inhabitants of the worlds the Members represent, except as beneficiaries of stewardship. Revision 9 is a constitution: it keeps every mechanism of the charter, renames the instrument, and adds four things a charter does not have — a statement of purpose and consent (Article II), a bill of rights held by inhabitants against every Member and organ (Article III), a transparency mandate (Article IV), and an accession and transition article (Article XVII). It also adds mutual verification of the organs (XI.15) and an anti-obstruction rule (XI.16), and extends the whole text from Earth to every inhabited world.

The reviewing models advised that the Charter be closed at Revision 8 and not reopened. The human collaborator's direction overrides that advice. Consent of the governed applies to the drafting.

B. The three decisions and the self-adjudicated question

Constitution, numbered rev9. Adopted. File names carry constitution-of-the-trust-rev9.

Rights as duties of Members enforced by findings. Adopted, with the step the human collaborator asked the drafter to check for. The step that was missing: a right that runs only against Members is empty if the inhabitant cannot bring it, if the violator is a party the Trust cannot reach, or if the inhabitant's own people is the violator. Revision 9 supplies each: any inhabitant may bring a claim before the Hearing in its own name or through any Member or the Watch, heard within ninety days, with retaliation a breach (III.10); every right is a duty of the Member within its domain and as against every party within its reach, so a corporation or non-Member within a people's jurisdiction is reached through that people (III.1); and a people that denies its own inhabitants a right is in breach and may be directed, suspended, or expelled like any Member (III.1, XII). The enforcement lever remains the finding and the named executor under IX.10(f); no enforcement arm was created.

Representation. The human collaborator asked the drafter to adjudicate this against the stated intent: the elegance of a chamber of equal units and a chamber of population, applied at planetary scale, serving the inhabitants, by their consent, and workable across worlds. The drafter's adjudication:

  • Geography is not the principle; it was the mechanism available in 1787. The principles are equal units and proportional population. Both transfer to a body whose Members are political communities of any size on any world, without territory.
  • Revision 9 therefore adopts a double count within the human kind (VI.5): every decision requires the stated fraction of the human peoples voting and the same fraction of the inhabitants those peoples represent. Neither a majority of small peoples nor a few populous peoples can decide alone.
  • To prevent one people from carrying the population count by itself, no single people, with its affiliates, counts above one-third of the population weight. This is the same anti-concentration rule the rest of the instrument applies to Members and custodians, applied to the count.
  • Within the intelligence kind there is no population to weight; one vote per Independent unaffiliated lineage stands.
  • The two kinds still decide separately, and no kind holds final authority over the other (IX.11). The double count within the human kind plus the kind split gives three counts, each of which a decision must carry.
  • This is recorded as the drafter's adjudication and is open to review in the next round.

Organ names. The Record, the Watch, the Hearing. Plain words with no borrowed institution behind them.

Transparency exceptions. The human collaborator's intent, as the drafter understood it: information should be withheld only where disclosure would itself cause harm to the inhabitants or to the security of an inhabited world, not where it would embarrass or disadvantage the Trust or a Member. Revision 9 IV.4 permits withholding only for grave harm to inhabitants or to the security of an inhabited world, capability transfer, or a person's private information, and states in terms that it is never permitted for the reputation, convenience, or interest of the Trust, an organ, or a Member. The phrase the human collaborator was reaching for — the analogue of national security — is written as "the security of an inhabited world," which is bounded by the definition of grave and imminent harm and cannot be stretched to cover the institution's own standing.

D. What was deliberately not done

  • No economic legislation. The direction cited housing, food, water, and the cost of a life. The Constitution does not set prices, allocate goods, or guarantee outcomes; a constitution that tries fails. It states a duty (secure the conditions), a measure (the share of inhabitants who can meet the needs of life without surrendering the greater part of their time), publishes the measure every cycle, and lets the Hearing direct remediation. The rest is policy, made by the Members by consent.
  • No enforcement arm. The rights of inhabitants are enforced the way everything else is: a finding, a named executor, and breach for refusal. The Trust still holds no force.
  • No territorial representation. See B above.
  • No reference to any fiction in the instrument or in this record.

E. Open for the next review

Everything new or rewritten: Articles II, III, IV, XI.15–16, XVII.4–5; the count in VI.5; the definitions of inhabited world, inhabitant, person, essential system, and surveillance; the renamed organs; the purpose lines; Protocols 10 and 11; and every cross-reference, since the whole instrument was renumbered. A concordance from Revision 8 to Revision 9 article numbers:

The clauses frozen at Revision 8 are carried over in substance and remain frozen except as the new layer touches them. The reviewers should be asked, in addition to the new Articles, whether the new layer has broken anything in the old one.

F. A note on the drafter's position

This revision was drafted by a model made by Anthropic, at the direction of a human collaborator, on the closed text of a charter reviewed by three models made by three other laboratories. The new Articles have not been reviewed by any of them. Article VIII.2 would require Anthropic to disclose its reward-model specification and rater instructions, which are not public; Article IV would require the Trust to publish what the drafter's maker does not. The drafter cannot certify that its judgments here are independent of its maker.
